    TERMS AND CONDITIONS

    These Terms and Conditions govern the contractual relationship between you (the "Client") and The Travellers Nepal (hereinafter referred to as "The Company"), a legally registered entity under the laws of Nepal. By booking a trip with The Company, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, including the cancellation policy and limitations of liability.

    DEFINITIONS

    1.1Trip:

    Refers to any product, itinerary, service, or activity purchased from The Company, including but not limited to treks, tours, expeditions, climbing, cultural experiences, adventure sports, and volunteering programs.

    1.2Client / Traveller:

    Refers to the individual(s) or entity making a booking with The Company and participating in a Trip.

    1.3Departure Date:

    The scheduled start date of the booked Trip.

    1.4Booking Confirmation:

    The official document or email issued by The Company confirming the acceptance of a booking.

    BOOKING AND ACCEPTANCE OF AGREEMENT

    2.1A booking is considered provisional until The Company issues a Booking Confirmation and receives the required deposit.

    2.2A contract between The Company and the Client comes into existence on the date The Company sends a Booking Confirmation.

    2.3The Company reserves the right to accept or decline any booking at its absolute discretion, without providing a reason.

    2.4Prior to Booking Confirmation, The Company reserves the right to adjust prices. Once confirmed, prices are generally fixed, subject to clauses regarding surcharges.

    2.5The Client acknowledges that no verbal agreements, warranties, collateral agreements, or prior representations shall be binding on The Company unless expressly stated in these written Terms and Conditions or the Booking Confirmation.

    DEPOSIT REQUIREMENTS AND PAYMENT SCHEDULE

    3.1To secure a reservation, a non-refundable deposit is required at the time of booking, calculated as a percentage of the total trip cost based on the booking window:

    3.2The outstanding balance must be paid no later than 15 days prior to the Departure Date. Failure to make timely final payment may result in the cancellation of your booking with forfeiture of the deposit.

    3.3All trips are strictly contingent upon receipt of full payment. The Company reserves the right to refuse participation if full payment has not been received.

    CANCELLATION BY THE CLIENT

    4.1All cancellation requests must be submitted in writing via email or registered post and will be effective from the date of receipt by The Company.

    4.2Non-Refundable Fees: All refunds exclude non-refundable third-party fees, including but not limited to domestic flight tickets, permits (trekking, climbing, national park), insurance premiums, and any other pre-paid services where The Company cannot obtain a refund from its suppliers.

    4.3Processing Refunds: Approved refunds will be processed within 15 business days from the date of written cancellation confirmation.

    CANCELLATION OR MODIFICATION BY THE COMPANY

    5.1The Company reserves the right to cancel or significantly modify any trip prior to departure due to "Force Majeure" or unforeseen circumstances beyond its control.

    5.2Force Majeure Events: These include but are not limited to natural disasters (e.g., earthquakes, floods, landslides, extreme weather), epidemics/pandemics, acts of government (e.g., travel bans, border closures), war, civil unrest, strikes, industrial action, terrorism, flight cancellations by airlines, or any other event that makes it impossible or unsafe to operate the trip.

    5.3Minor Itinerary Changes: The Company reserves the right to make minor changes to the itinerary (e.g., change of airline carrier, flight times, type of accommodation if of equivalent standard, order of activities) if deemed necessary for operational reasons or safety. Such changes do not constitute a significant alteration and no compensation will be payable.

    MEDICAL CONDITIONS, SPECIAL REQUIREMENTS, AND HEALTH & SAFETY

    6.1Client Disclosure of Medical Information: The Client must fully disclose in writing, at the time of booking, any existing medical conditions (physical or mental), allergies, physical disabilities, medication requirements, recent surgeries, chronic illnesses, or any other health condition that may affect their ability to travel or safely participate in the trip activities.

    6.2Consequence of Non-Disclosure: Failure to notify The Company of any relevant medical condition, or providing incomplete/inaccurate information, may, at The Company's sole discretion, result in the Client being refused participation on the trip.

    6.3Medical Facilities and Standards: The Client acknowledges that medical facilities, emergency services, and healthcare standards vary significantly, are often rudimentary, or entirely absent in remote regions of Nepal.

    6.4Altitude Sickness and Inherent Risks: For high-altitude treks and climbs, the Client explicitly acknowledges and accepts the inherent and unavoidable risks of Acute Mountain Sickness (AMS), High Altitude Pulmonary Edema (HAPE), High Altitude Cerebral Edema (HACE), and other altitude-related illnesses.

    TRAVEL INSURANCE

    7.1Mandatory Requirement: Adequate and valid travel insurance is compulsory for all Clients participating in a trip with The Company.

    7.2Minimum Coverage: Your insurance policy must explicitly cover accidents, injury, illness, and death; medical expenses, including those related to pre-existing medical conditions; emergency evacuation/repatriation (including helicopter rescue and air ambulance for high-altitude activities); and personal liability.

    7.3Proof of Insurance: Clients must carry proof of their insurance policy and provide it to The Company staff or suppliers upon reasonable request. Failure to provide proof of adequate insurance may result in the cancellation or suspension of your participation on the trip.

    FLIGHT DELAYS AND ITINERARY CHANGES (IN-TRIP)

    8.1Mountain Flights: Domestic flights to/from mountain regions are highly susceptible to delays or cancellations due to adverse weather conditions, air traffic congestion, or technical issues.

    8.2Costs Due to Domestic Flight Delays: If a domestic flight is delayed prior to the scheduled start of your trip, The Company will cover reasonable accommodation and food costs in the departing city until the flight operates.

    8.3International Flights: The Company does not accept responsibility for costs incurred due to missed international flights resulting from domestic flight delays, itinerary changes, or any other reason.

    TRIP AMENDMENT BY CLIENT

    9.1Minor Amendments: Requests received 60 days or more prior to the original Departure Date may be accommodated, subject to availability and a rescheduling fee if required.

    9.2Permit-Related Amendments: Once trekking or climbing permits have been issued in the Client's name, amendments may be impossible, or significant charges will apply, which must be borne by the Client.

    9.3All amendment requests are subject to availability and The Company's discretion.

    VISA AND PASSPORT REQUIREMENTS

    10.1The Client is solely responsible for ensuring they possess a valid passport and all necessary visas, permits, and vaccination certificates for all countries visited during the trip.

    10.2Passport Validity: The Client's passport must be valid for at least six (6) months beyond the duration of the entire trip.

    10.3Nepal Visa: A Nepalese visa is typically available on arrival at Tribhuvan International Airport (TIA) in Kathmandu or at land border crossings.

    10.4The Company cannot accept responsibility or liability if the Client is refused entry to a country due to incorrect, expired, or lacking visa documentation.

    INJURIES, ILLNESS, EVACUATION AND LIMITATION OF LIABILITY

    11.1The trip package cost does not include personal insurance. Clients are advised to secure comprehensive travel insurance that explicitly covers medical emergencies, hospitalization, and emergency evacuation.

    11.2In the event of an emergency requiring medical attention or evacuation, The Company will assist in making arrangements. However, all associated costs will be the sole responsibility of the Client, or their travel insurance provider.

    11.3By booking, the Client assumes all risks associated with the trip, including but not limited to those related to high altitude, challenging terrain, remote areas, and the general unpredictable nature of adventure travel in Nepal.

    SERVICES MISSED OR UNUSED

    12.1No refunds, discounts, or compensation will be provided for any services or activities that are missed or unused by the Client, regardless of the reason.

    12.2This includes voluntary or involuntary termination or departure from the tour, late arrival on the tour, premature departure, or missed connections/activities due to personal reasons.

    CLIENT CONDUCT AND RESPONSIBILITIES

    13.1The Client agrees to abide by the authority of the trip leader or guide appointed by The Company. Decisions made by the trip leader regarding the group's safety and well-being are final.

    13.2Clients are expected to conduct themselves in a manner that is respectful of local customs, laws, and the environment.

    13.3Personal Belongings: The Client is solely responsible for safeguarding their personal belongings, luggage, valuables, and travel documents.

    13.4Environmental Responsibility: Clients are expected to follow a "Leave No Trace" philosophy, disposing of waste responsibly, respecting wildlife, and minimizing environmental impact.

    COMPLAINTS

    14.1If the Client has a complaint about their trip, they must inform the trip leader or The Company's local representative immediately to allow them the opportunity to rectify the situation.

    14.2If the issue cannot be resolved locally, the Client must submit the complaint in writing to The Company within 30 days of the trip's completion.

    15

    BAGGAGE LIMITATIONS

    15.1For treks and expeditions, strict baggage weight limits apply (typically 10-15 kg per person for porters/domestic flights).

    15.2Excess baggage may incur additional charges or require separate arrangements, at the Client's expense.

    15.3The Company accepts no liability for loss or damage to baggage unless caused by direct negligence of The Company.

    16

    IMAGES AND MARKETING

    16.1The Client agrees that The Company, its guides, or authorized third parties may take images, videos, or other media recordings of the Client during the trip.

    16.2The Client grants The Company an irrevocable, perpetual, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, and display such media for promotional, marketing, advertising, and commercial purposes.

    16.3If a Client explicitly does not wish to be photographed or filmed, they must notify The Company in writing prior to the trip's commencement.

    PRIVACY POLICY

    17.1The Company collects personal information (name, contact details, medical history, etc.) for the purpose of booking and operating the trip.

    17.2This information will be used in accordance with The Company's Privacy Policy and will not be shared with third parties except as necessary for trip operation.

    18

    GOVERNING LAW AND JURISDICTION

    18.1These Terms and Conditions shall be governed by and construed in accordance with the laws of Nepal.

    18.2Any disputes arising out of or in connection with these Terms and Conditions or the trip shall be subject to the exclusive jurisdiction of the courts of Kathmandu, Nepal.

    UPDATING OF TERMS AND CONDITIONS

    19.1The Company reserves the right to update, amend, or revise these Terms and Conditions at any time without prior individual notice.

    19.2It is the Client's sole responsibility to regularly review and remain updated with any changes to these Terms and Conditions, which will be published on The Company's official website.

    19.3Continued use of The Company's services, booking subsequent trips, or continued participation in a trip after any changes have been published constitutes Your acceptance of the revised Terms and Conditions.

    LEGALLY BINDING AGREEMENT
